PLEASE READ THIS AGREEMENT CAREFULLY TO ENSURE THAT YOU UNDERSTAND EACH PROVISION. THIS AGREEMENT CONTAINS A MANDATORY INDIVIDUAL ARBITRATION PROVISION, WHICH REQUIRES, UNLESS YOU OPT OUT PURSUANT TO THE INSTRUCTIONS UNDER THE HEADING “RIGHT TO OPT OUT OF ARBITRATION” THE EXCLUSIVE USE OF FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES BETWEEN YOU AND COMPANY, INCLUDING ANY CLAIMS THAT AROSE OR WERE ASSERTED BEFORE YOU AGREED TO THESE TERMS. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU EXPRESSLY WAIVE YOUR RIGHT TO SEEK RELIEF IN A COURT OF LAW AND TO HAVE A JURY TRIAL ON YOUR CLAIMS, AS WELL AS YOUR RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE ACTION OR PROCEEDING.

User’s Acknowledgment and Acceptance of Terms

You are permitted to use the Services only if you: (i) Represent that you are able to form a binding contract in your jurisdiction; (ii) Comply with our Terms of Service and all applicable local, state and national laws, rules and regulations; (iii) Will not copy or distribute any part of any part of the Services in any medium without Company’s prior written authorization except as permitted through the Website’s functionality and under these Terms of Service; (iv) Provide accurate and complete information when creating an account; (v) Acknowledge you are solely responsible for the activity that occurs while signed in to or while using the Services; (vi) Don’t collect any personally identifiable information, including full names, physical addresses, or e-mail addresses, for commercial purposes; and (vii) Acknowledge your sole responsibility for your content submissions, including discussion posts, profile information and links, pictures, and other such content. The Services are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, the Services are not available to children (persons under the age of 18) or users who have had their user account temporarily or permanently deactivated. By becoming a user, you represent and warrant that you are at least 18 years old and that you have the right, authority, and capacity to enter into and abide by the terms and conditions of this Agreement.

By accessing or using the services, or clicking a button or checking a box marked “I agree” (or something similar), you signify that you have read and understood and agree to be bound by this agreement, which is subject to change at any time. If you do not wish to be bound by these terms of service, log off now. Your sole remedy for dissatisfaction with the services or any product, content, or information available on or through the website is to stop using the services.

Subject to these Terms of Service, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Services for your internal use only and as permitted by the features of the Services. NextRx reserves all rights not expressly granted herein in the Service and the Company Content. NextRx may terminate this license at any time for any reason or for no reason.

Throughout these Terms of Service, we use the first-person pronoun “we” to refer to the user as a representative of their organization. The term “User(s)” refers to an individual accessing the Services, as well as any organization or person accessing the Services for an organization.
